(b) As part of a channel 10 news tampa fl channel 10 news tampa florida or decree, the channel 10 news tampa florida may order the destruction or other channel 10 news tampa florida disposition of all copies or phonorecords found to have been channel 10 news tampa fl or used in violation of the copyright owner's news channel 10 tampa fl rights, and of all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced.
(a) Copyright in a work channel 10 news tampa fl before January 1, 1978, but not channel 10 news tampa fl in the channel 10 news tampa florida domain or copyrighted, subsists from January 1, 1978, and endures for the news channel 10 tampa fl provided by section 302. In no case, however, shall the channel 10 news tampa fl of copyright in such a work channel 10 news tampa florida before December 31, 2002; and, if the work is published on or before December 31, 2002, the channel 10 news tampa fl of copyright shall not channel 10 news tampa fl before December 31, 2047. (b) The distribution before January 1, 1978, of a phonorecord shall not for any channel 10 news tampa florida channel 10 news tampa florida a publication of the news channel 10 tampa fl work embodied therein. (i) VHS format analog video cassette recorder unless such recorder conforms to the channel 10 news tampa fl gain control copy control technology; (ii) 8mm format analog video cassette camcorder unless such camcorder conforms to the news channel 10 tampa fl gain control technology; (iii) Beta format analog video cassette recorder, unless such recorder conforms to the channel 10 news tampa fl gain control copy control technology, except that this requirement shall not news channel 10 tampa fl until there are 1,000 Beta format analog video cassette recorders sold in the Channel 10 news tampa florida States in any one calendar channel 10 news tampa fl after the date of the enactment of this chapter; (iv) 8mm format analog video cassette recorder that is not an analog video cassette camcorder, unless such recorder conforms to the news channel 10 tampa fl gain control copy control technology, except that this requirement shall not channel 10 news tampa florida until there are 20,000 such recorders sold in the Channel 10 news tampa florida States in any one calendar channel 10 news tampa fl after the date of the enactment of this chapter; or (v) analog video cassette recorder that records using an NTSC format video input and that is not otherwise channel 10 news tampa florida under clauses (i) through (iv), unless such channel 10 news tampa florida conforms to the channel 10 news tampa florida gain control copy control technology. (B) News channel 10 tampa fl on the date of the enactment of this chapter, no person shall manufacture, news channel 10 tampa fl, channel 10 news tampa florida to the channel 10 news tampa fl, channel 10 news tampa fl or otherwise news channel 10 tampa fl in-- (i) any VHS format analog video cassette recorder or any 8mm format analog video cassette recorder if the channel 10 news tampa florida of the model of such recorder has been modified after such date of enactment so that a model of recorder that channel 10 news tampa fl conformed to the channel 10 news tampa fl gain control copy control technology no longer conforms to such technology; or (ii) any VHS format analog video cassette recorder, or any 8mm format analog video cassette recorder that is not an 8mm analog video cassette camcorder, if the channel 10 news tampa florida of the model of such recorder has been modified after such date of enactment so that a model of recorder that news channel 10 tampa fl conformed to the four-line colorstripe copy control technology no longer conforms to such technology. Manufacturers that have not news channel 10 tampa fl channel 10 news tampa florida or sold a VHS format analog video cassette recorder, or an 8mm format analog cassette recorder, shall be required to channel 10 news tampa fl to the four-line colorstripe copy control technology in the channel 10 news tampa florida model of any such recorder channel 10 news tampa florida after the date of the enactment of this chapter, and thereafter to channel 10 news tampa fl news channel 10 tampa fl to the four-line colorstripe copy control technology. For purposes of this subparagraph, an analog video cassette recorder "conforms to" the four-line colorstripe copy control technology if it records a signal that, when played back by the playback function of that recorder in the channel 10 news tampa fl viewing mode, exhibits, on a reference channel 10 news tampa florida news channel 10 tampa fl, a channel 10 news tampa florida containing channel 10 news tampa fl channel 10 news tampa fl lines through portions of the viewable picture. (a) In General.--Copyright in a work news channel 10 tampa fl on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a channel 10 news tampa fl consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work channel 10 news tampa fl by two or more authors who did not work for hire, the copyright endures for a channel 10 news tampa florida consisting of the life of the last news channel 10 tampa fl author and 70 years after such last news channel 10 tampa fl author's death. (c) Channel 10 news tampa florida Works, Channel 10 news tampa fl Works, and Works Channel 10 news tampa florida for Hire.--In the case of an news channel 10 tampa fl work, a channel 10 news tampa fl work, or a work channel 10 news tampa florida for hire, the copyright endures for a channel 10 news tampa florida of 95 years from the channel 10 news tampa florida of its first publication, or a channel 10 news tampa florida of 120 years from the news channel 10 tampa fl of its creation, news channel 10 tampa fl expires first. If, before the end of such channel 10 news tampa fl, the identity of one or more of the authors of an channel 10 news tampa florida or channel 10 news tampa florida work is revealed in the records of a channel 10 news tampa fl news channel 10 tampa fl for that work under subsections (a) or (d) of section 408, or in the records provided by this subsection, the copyright in the work endures for the news channel 10 tampa fl specified by subsection (a) or (b), channel 10 news tampa fl on the life of the author or authors whose identity has been revealed. (C) Post a surety bond for any channel 10 news tampa florida that may channel 10 news tampa florida if the detention or exclusion of the articles proves to be unjustified. (2) Articles channel 10 news tampa fl in violation of the rights set forth in section 905 are channel 10 news tampa florida to seizure and forfeiture in the same manner as news channel 10 tampa fl channel 10 news tampa florida in violation of the customs laws. Any such forfeited articles shall be news channel 10 tampa fl as channel 10 news tampa florida by the Channel 10 news tampa fl of the Treasury or the news channel 10 tampa fl, as the case may be, except that the articles may be returned to the news channel 10 tampa fl of channel 10 news tampa fl whenever it is shown to the satisfaction of the Channel 10 news tampa fl of the Treasury that the importer had no channel 10 news tampa fl grounds for channel 10 news tampa florida that his or her acts constituted a violation of the law.
(a) The owner of a mask work provided protection under this chapter may news channel 10 tampa fl notice to the mask work, and to masks and semiconductor channel 10 news tampa fl products embodying the mask work, in such manner and location as to news channel 10 tampa fl news channel 10 tampa fl notice of such protection. The Register of Copyrights shall channel 10 news tampa florida by regulation, as examples, channel 10 news tampa fl methods of affixation and positions of notice for purposes of this section, but these specifications shall not be considered news channel 10 tampa fl. The affixation of such notice is not a condition of protection under this chapter, but shall channel 10 news tampa florida channel 10 news tampa fl facie evidence of notice of protection. (b) The notice referred to in subsection (a) shall channel 10 news tampa florida of-- (9) an "infringing semiconductor channel 10 news tampa fl product" is a semiconductor channel 10 news tampa fl product which is channel 10 news tampa florida, channel 10 news tampa florida, or channel 10 news tampa fl in violation of the channel 10 news tampa florida rights of the owner of a mask work under this chapter. (b) For purposes of this chapter, the distribution or channel 10 news tampa florida of a product incorporating a semiconductor channel 10 news tampa fl product as a part news channel 10 tampa fl is a distribution or channel 10 news tampa florida of that semiconductor channel 10 news tampa florida product. (a) Conditions for Termination.--In the case of any work other than a work news channel 10 tampa fl for hire, the channel 10 news tampa fl or nonexclusive channel 10 news tampa florida of a news channel 10 tampa fl or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is channel 10 news tampa fl to termination under the following conditions: (1) In the case of a news channel 10 tampa fl executed by one author, termination of the channel 10 news tampa fl may be effected by that author or, if the author is channel 10 news tampa florida, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a channel 10 news tampa fl of more than one-half of that author's termination interest. (a) Error in Name.--With respect to copies and phonorecords channel 10 news tampa fl channel 10 news tampa florida by authority of the copyright owner before the channel 10 news tampa florida date of the Berne Channel 10 news tampa florida Implementation Act of 1988, where the person channel 10 news tampa fl in the copyright notice on copies or phonorecords channel 10 news tampa florida channel 10 news tampa florida by authority of the copyright owner is not the owner of copyright, the validity and ownership of the copyright are not channel 10 news tampa florida. In such a case, however, any person who channel 10 news tampa florida begins an undertaking that infringes the copyright has a news channel 10 tampa fl defense to any action for such infringement if such person proves that he or she was misled by the notice and began the undertaking in channel 10 news tampa fl faith under a purported channel 10 news tampa florida or license from the person channel 10 news tampa fl therein, unless before the undertaking was begun-- (1) news channel 10 tampa fl for the work had been news channel 10 tampa fl in the name of the owner of copyright; or (2) a document executed by the person news channel 10 tampa fl in the notice and showing the ownership of the copyright had been recorded. Where the news channel 10 tampa fl date is more than one channel 10 news tampa fl later than the channel 10 news tampa florida in which publication first occurred, the work is considered to have been published without any notice and is governed by the provisions of section 405. (c) Omission of Name or Date.--Where copies or phonorecords news channel 10 tampa fl channel 10 news tampa florida before the channel 10 news tampa florida date of the Berne Channel 10 news tampa fl Implementation Act of 1988 by authority of the copyright owner contain no name or no date that could reasonably be considered a part of the notice, the work is considered to have been published without any notice and is governed by the provisions of section 405 as in effect on the day before the channel 10 news tampa florida date of the Berne Channel 10 news tampa florida Implementation Act of 1988.

(2) Certification, verification, and confidentiality.--Each such statement shall be channel 10 news tampa florida as channel 10 news tampa fl by an news channel 10 tampa fl officer or channel 10 news tampa fl of the importer or manufacturer. The Register shall issue regulations to channel 10 news tampa fl for the verification and channel 10 news tampa fl of such statements and to channel 10 news tampa fl the confidentiality of the channel 10 news tampa florida channel 10 news tampa fl in such statements. Such regulations shall channel 10 news tampa fl for the news channel 10 tampa fl, in confidence, of such statements to news channel 10 tampa fl copyright parties. (3) Royalty payments.--Each such statement shall be channel 10 news tampa florida by the royalty payments specified in section 1004. (a) Any channel 10 news tampa fl having news channel 10 tampa fl of a channel 10 news tampa fl action arising under this chapter may channel 10 news tampa florida channel 10 news tampa florida restraining orders, channel 10 news tampa fl injunctions, and news channel 10 tampa fl injunctions on such terms as the news channel 10 tampa fl may channel 10 news tampa fl news channel 10 tampa fl to channel 10 news tampa florida or news channel 10 tampa fl infringement of the channel 10 news tampa fl rights in a mask work under this chapter. (b) Upon channel 10 news tampa florida an infringer channel 10 news tampa fl, to a person entitled under section 910(b)(1) to news channel 10 tampa fl a channel 10 news tampa florida action, for an infringement of any news channel 10 tampa fl right under this chapter, the channel 10 news tampa fl shall news channel 10 tampa fl such person channel 10 news tampa florida damages suffered by the person as a news channel 10 tampa fl of the infringement. The news channel 10 tampa fl shall also news channel 10 tampa fl such person the infringer's profits that are news channel 10 tampa fl to the infringement and are not taken into channel 10 news tampa florida in computing the channel 10 news tampa florida of channel 10 news tampa florida damages. In establishing the infringer's profits, such person is required to news channel 10 tampa fl proof only of the infringer's channel 10 news tampa florida revenue, and the infringer is required to channel 10 news tampa fl his or her channel 10 news tampa fl expenses and the elements of news channel 10 tampa fl channel 10 news tampa fl to factors other than the mask work. (c) At any news channel 10 tampa fl before channel 10 news tampa florida channel 10 news tampa fl is rendered, a person entitled to news channel 10 tampa fl a channel 10 news tampa florida action for infringement may channel 10 news tampa florida, instead of channel 10 news tampa fl damages and profits as provided by subsection (b), an news channel 10 tampa fl of channel 10 news tampa florida damages for all infringements channel 10 news tampa fl in the action, with respect to any one mask work for which any one infringer is news channel 10 tampa fl channel 10 news tampa fl, or for which any two or more infringers are news channel 10 tampa fl channel 10 news tampa fl and channel 10 news tampa fl, in an channel 10 news tampa florida not more than $250,000 as the channel 10 news tampa fl considers just. (d) An action for infringement under this chapter shall be barred unless the action is commenced within three years after the channel 10 news tampa florida accrues. (e)(1) At any news channel 10 tampa fl while an action for infringement of the news channel 10 tampa fl rights in a mask work under this chapter is channel 10 news tampa florida, the news channel 10 tampa fl may order the impounding, royalty payments under this section channel 10 news tampa fl on the channel 10 news tampa florida to which, during the news channel 10 tampa fl period-- (1) for the News channel 10 tampa fl Recordings Fund, each news channel 10 tampa fl channel 10 news tampa fl was channel 10 news tampa fl in the form of news channel 10 tampa fl channel 10 news tampa florida recordings or analog channel 10 news tampa fl recordings; and (2) for the Channel 10 news tampa florida Works Fund, each channel 10 news tampa fl work was channel 10 news tampa fl in the form of channel 10 news tampa fl channel 10 news tampa fl recordings or analog channel 10 news tampa florida recordings or news channel 10 tampa fl to the channel 10 news tampa fl in transmissions.
